Consumer Litigation

Have you bought faulty goods or services?

Do you know that the following terms are implied when goods are sold or services supplied (subject to certain conditions)?

  • Goods or services must correspond with the description, if sold by description.
  • Goods or services must be of satisfactory quality. Please also note that this does not apply if defects are shown to the customer or defects existed which the customer's examination ought to have revealed.
  • The goods or services must be fit for the purpose for which they were intended. Please note this does not apply if defects are specifically drawn to the attention of the customer or if the customer examines the goods.
  • The seller legally owns the goods or services which he is selling.

It is important to note that if you have bought faulty goods or services, you may not be entitled to reject the goods or services if you do not complain with a "reasonable" time, although you may still be able to claim damages.
