Children

When making an order in relation to children, the Court must pay attention to the following:

  • The ascertainable wishes and feelings of the child.
  • The child's physical, emotional and educational needs.
  • The likely effect on the child of any change in circumstances.
  • The child's age, sex, background etc.
  • Any harm the child has suffered/may suffer.
  • The capability of the parents (and other relevant people) to care for the child.
