Common Clauses used in Wills
 

The following list of clauses will give you an idea of what you will need to consider when writing a Will.

- Commencement

- Revocation of previous Wills

- Disposal of remains

- Appointment of Executors who will distribute the estate as directed in the Will

- Appointment of guardians to look after children under the age of 18

- Legacies

  • General - property in the estate
  • Demonstrative - from a specific fund
  • Specific - a particular item or items in the estate
  • Pecuniary - a gift of specific money
  • Residuary - whatever is left in the estate after the payment of debts, expenses and other legacies

- Administrative powers

- Attestation clause which is evidence that the Will has been properly executed
